1. Who provides this warranty, and what it applies to

This Limited Warranty is provided by Miles Labs, Inc. (“Miles,” “we,” “us”), 1500 N. Grant St #4877, Denver, CO 80203. It applies to a new Miles Plug purchased from mileslabs.com or an authorized channel. It does not apply to devices sold as used, “as is,” as a sample, or “not for sale,” or purchased from an unauthorized retailer.

2. Coverage

Miles warrants the Miles Plug against defects in materials and workmanship, under normal consumer use, for one (1) year from the date of the original retail purchase. If a covered defect arises during that period and you follow the claim instructions below, we will, at our option and to the extent permitted by law, either: (i) repair the device using new or refurbished parts; (ii) replace it with a new or refurbished device equivalent to the original; or (iii) refund all or part of the purchase price. Replaced parts, and any device for which a refund is given, become our property.

3. Repaired or replacement units

A repaired or replacement device is warranted for the remainder of the original one-year period or for 90 days from the date of repair or replacement, whichever is longer.

4. Who is covered

This Limited Warranty is provided to the original purchaser only and is not transferable to a subsequent owner.

5. What is not covered

Loss or theft; accidental or physical damage; misuse, abuse, or neglect; and normal wear or cosmetic damage that does not affect function.
Improper installation, or use with an unapproved adapter, splitter, or extension; and unauthorized repair, alteration, tampering, or modification.
Breakdowns, fluctuations, or interruptions in electrical power or in the cellular/telecommunications network.
Acts of God, including lightning, flood, fire, tornado, earthquake, or hurricane.
Consumable parts, unless the failure is due to a defect in materials or workmanship.
The Miles app, the AI assistant, the Miles Score, and the Miles services and software (which are covered, if at all, under the Terms of Service, not this hardware warranty).
Any device not purchased new from mileslabs.com or an authorized channel.

We do not warrant that the device or the Services will operate uninterrupted or error-free.

6. How to make a claim

Contact us at mileslabs.com/support during the warranty period to start a warranty claim, and follow our return instructions. You may need to return the device in its original or equally protective packaging to the address we specify, and return of the defective unit may be required. We may decline warranty service for a device that, on inspection, is not covered by this warranty.

7. Disclaimer of other warranties

TO THE EXTENT PERMITTED BY LAW, THE WARRANTY AND REMEDIES ABOVE ARE EXCLUSIVE AND IN LIEU OF ALL OTHER WARRANTIES, AND MILES DISCLAIMS ALL OTHER EXPRESS, IMPLIED, OR STATUTORY WARRANTIES, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF MILES CANNOT LAWFULLY DISCLAIM AN IMPLIED OR STATUTORY WARRANTY, THEN TO THE EXTENT PERMITTED BY LAW ANY SUCH WARRANTY IS LIMITED IN DURATION TO THE ONE-YEAR TERM OF THIS LIMITED WARRANTY AND TO REPAIR, REPLACEMENT, OR REFUND. SOME STATES DO NOT ALLOW LIMITS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THIS LIMITATION MAY NOT APPLY TO YOU.

8. Limitation of damages

TO THE EXTENT PERMITTED BY LAW, MILES IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM THE DEVICE OR THIS WARRANTY, AND MILES’S TOTAL LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE DEVICE. NOTHING IN THIS WARRANTY LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW, INCLUDING FOR DEATH OR PERSONAL INJURY WHERE SUCH A LIMIT IS PROHIBITED. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THIS MAY NOT APPLY TO YOU.

This is consistent with the limitation of liability in the Terms of Service (§11).

9. Your legal rights

This Limited Warranty gives you specific legal rights, and you may have other rights that vary by state.

10. Not a safety device; relationship to the Terms of Service

This is a hardware warranty for the Miles Plug only. It is not a promise that any driving-insights, AI, crash-response, roadside, or other safety or emergency feature will function; those features and their limitations are governed by the Terms of Service (including Sections 7 and 8). This Limited Warranty is the express limited device warranty referred to in the Terms of Service (see Sections 3, 5, and 10), is the express warranty on the device, and is a one-year warranty that is not tied to an active membership.
